Abstract:

This paper explores the intricate landscape of digital regulation within Kyrgyzstan, focusing specifically on the legal frameworks governing banking, and finance. Utilizing a comprehensive legal analysis method, the research draws upon current legislation, policy documents, and case studies from various digital finance entities operating within the country. Additionally, interviews with key stakeholders, including regulators, legal experts, and industry leaders, provide nuanced insights into the practical implications of these regulations.

Our findings reveal that while Kyrgyzstan has made significant strides in developing a digital regulatory framework by adopting a digital code, there are critical areas needing further refinement to foster a robust digital economy. The study identifies key challenges, such as gaps in cybersecurity measures, ambiguities in digital banking regulations, and the need for more coherent guidelines on blockchain and cryptocurrency use. Specific recommendations include enhancing cybersecurity protocols, clarifying legal definitions related to digital assets, and fostering greater collaboration between regulatory bodies and digital enterprises.

The relevance of this research extends beyond Kyrgyzstan, offering valuable lessons for other emerging economies navigating the digital transformation of their financial sectors. By situating Kyrgyzstan's experience within the broader context of global digital regulation trends, this paper contributes to the scholarly discourse on how developing nations can effectively balance innovation with regulatory oversight.
